These Terms of Use constitute a legally binding agreement between you (the participant) and the event organiser under the laws of Malaysia, including the Contracts Act 1950.

By registering for this event, you acknowledge and agree to the following terms:

1. All registration information submitted must be true, complete and accurate. You are responsible for providing correct contact details, IC/passport number, emergency contact information and any other required fields. Providing false information may result in immediate disqualification without refund.

2. You must be at least 18 years of age, or have obtained consent from your parent or legal guardian if under 18, to register and participate in this event.

3. You must follow all event rules, safety instructions, marked routes, time schedules and directions given by the event organiser, marshals and authorised personnel at all times.

4. The event organiser reserves the right to refuse participation, disqualify or remove any participant who fails to comply with event rules, safety instructions or who engages in unsafe, disruptive or unsportsmanlike behaviour.

5. The event organiser may modify the event route, schedule, format, venue or any other aspect of the event due to weather, safety, logistical or regulatory requirements without prior notice.

6. You are responsible for your own personal belongings, equipment and vehicle at all times. The organiser and FlagOff.my are not responsible for any loss, theft or damage.

7. By registering, you consent to the use of your name, image, likeness and event participation in event-related media, promotional material and reporting by the event organiser, subject to the Personal Data Protection Act 2010 (PDPA).

8. Your personal data will be processed in accordance with the PDPA 2010 and will be used solely for event registration, payment verification, invoice and receipt generation, event communication, WhatsApp group access and security records. Your data will not be sold or shared with unauthorised third parties.

9. FlagOff.my is the registration platform only. The event is organised, managed and operated solely by the event organiser. All event-related matters including safety, refunds, disputes and operations are the organiser's responsibility.

10. These terms shall be governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

This Refund Policy is governed by the laws of Malaysia, including the Consumer Protection Act 1999 where applicable.

Please read this refund policy carefully before registering and making payment.

1. All registration fees paid are non-refundable unless the event is cancelled by the event organiser.

2. No refunds will be issued for participant cancellation, no-show, late arrival, voluntary withdrawal, failure to complete the event, disqualification or removal for rule violations.

3. If the event is postponed by the organiser to a new date, your registration will automatically transfer to the new date. If you cannot attend the new date, you must notify the organiser in writing within 7 days of the postponement announcement. The organiser's decision on refunds, credits or transfers will apply.

4. If the event is cancelled by the organiser, the organiser shall communicate refund, transfer or credit arrangements to participants within 30 days of the cancellation announcement. Refund requests must be submitted in writing to the organiser within 14 days of receiving the cancellation notice.

5. Payment gateway fees, bank charges and third-party processing fees are non-refundable under any circumstances. The refund amount shall be the registration fee paid less any applicable processing charges.

6. No refunds will be given due to weather conditions, natural disasters (including but not limited to floods, storms, earthquakes), government restrictions, force majeure events, or any circumstances beyond the organiser's reasonable control, unless the event is formally cancelled by the organiser.

7. Refund decisions are made solely by the event organiser. FlagOff.my does not hold participant funds and cannot process refunds on behalf of the organiser.

8. Any dispute regarding refunds shall first be resolved through negotiation between the participant and organiser. If unresolved, the matter shall be subject to the exclusive jurisdiction of the courts of Malaysia.

All participants must read, understand and follow these safety rules at all times. These rules are designed to protect your safety and the safety of others.

1. SAFETY GEAR: Wear all required safety gear at all times during the event. For motorsport events, helmets meeting SIRIM, DOT, ECE or Snell safety standards are mandatory. For cycling events, helmets meeting recognised safety standards are mandatory. The organiser will specify the required protective clothing, gloves and footwear for each event. Failure to wear required safety gear will result in immediate disqualification.

2. FOLLOW INSTRUCTIONS: Follow all instructions given by event marshals, officials, route markers, signage and authorised personnel. Do not deviate from marked routes or enter restricted areas unless instructed by event officials.

3. NO SUBSTANCES: Do not participate under the influence of alcohol, drugs, medication that impairs judgement, or any substance that may affect your ability to participate safely. This includes prescription medication that carries warnings about operating vehicles or machinery. The organiser reserves the right to conduct breathalyser or sobriety checks.

4. SKILL LEVEL: Ride and drive within your skill level. Do not attempt any section, obstacle or manoeuvre beyond your ability. If you are unsure about a section, seek guidance from event marshals before proceeding.

5. SAFE DISTANCE: Maintain a safe distance from other participants at all times. Reckless, dangerous or aggressive riding or driving will result in immediate disqualification and may be reported to the relevant authorities.

6. INCIDENT REPORTING: Report any incident, injury, accident or unsafe condition to the nearest event marshal or organiser immediately. Do not move an injured person unless absolutely necessary to prevent further harm. Cooperate fully with any investigation conducted by the organiser or authorities.

7. EMERGENCY CONTACT: Carry a mobile phone with sufficient battery and ensure your emergency contact information is accurate and reachable during the event. Store the event organiser's emergency contact number in your phone before the event begins.

8. EVENT MODIFICATIONS: The organiser reserves the right to stop, delay, modify or cancel any part of the event due to weather, safety conditions, accidents, regulatory requirements or any other reason deemed necessary for participant safety.

9. MEDICAL TREATMENT: In case of injury or medical emergency, you authorise the organiser and medical personnel to arrange medical treatment, evacuation or transport as deemed necessary. You acknowledge that you are responsible for all medical costs incurred, and you are advised to hold adequate personal accident and medical insurance.

10. ROAD RULES: For events on public roads, you must comply with all applicable Malaysian road traffic laws, including the Road Transport Act 1987, unless the road has been officially closed by the relevant authorities for the event. For off-road events, you must comply with all applicable land access regulations and environmental protection requirements.

11. REMOVAL WITHOUT REFUND: Failure to follow these safety rules may result in immediate removal from the event without refund. The organiser's decision on safety matters is final.

12. ACKNOWLEDGEMENT: By participating, you acknowledge that you have read, understood and agreed to these safety rules. Safety is a shared responsibility — your cooperation helps ensure a safe event for everyone.

IMPORTANT: This is a legally binding waiver of liability under the laws of Malaysia. Please read carefully before registering.

By registering and participating in this event, you acknowledge and agree to the following:

1. You understand that participation in this event involves inherent risks and dangers including but not limited to: physical injury, spinal injury, paralysis, death, property damage, equipment failure, road hazards, collisions with other participants or vehicles, animal encounters, exposure to extreme weather conditions, inadequate or delayed medical assistance, and any other foreseeable or unforeseeable risks associated with motorsport, off-road, cycling, running or outdoor activities.

2. You voluntarily assume and accept all such risks, whether known or unknown, inherent or otherwise, arising from your participation in this event.

3. To the fullest extent permitted by law, including but not limited to the Contracts Act 1950 and the Civil Law Act 1956, you hereby release, waive, discharge and hold harmless the event organiser, its officers, directors, employees, volunteers, agents, sponsors, partners, venue owners, land owners, government authorities and FlagOff.my (collectively, the "Released Parties") from any and all claims, demands, losses, damages, liabilities, costs and expenses (including legal fees) arising from or in connection with your participation in this event, whether caused by negligence of the Released Parties or otherwise.

4. This waiver extends to all claims including but not limited to claims for personal injury, wrongful death, property damage, loss of consortium, breach of contract, and any other claim arising under Malaysian law.

5. You confirm that you are physically fit, adequately trained and medically capable of safely participating in this event. You accept full responsibility for your own fitness, health and safety. You are advised to seek medical clearance before participating if you have any pre-existing medical conditions.

6. You agree to wear all required safety gear including but not limited to helmets meeting SIRIM or international safety standards, protective clothing, gloves and footwear as specified by the event organiser.

7. You agree that this waiver and release is binding on you, your heirs, next of kin, executors, administrators, assigns and legal representatives.

8. You agree to indemnify and hold harmless the Released Parties from any loss, liability, damage or cost incurred as a result of your participation in this event.

9. If any provision of this waiver is found to be invalid or unenforceable by a court of competent jurisdiction in Malaysia, the remaining provisions shall continue in full force and effect.

10. This waiver shall be governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with this waiver shall be subject to the exclusive jurisdiction of the courts of Malaysia.
